1. Agreement

These Terms of Use are an agreement between you and QRITON TECHNOLOGIES S.R.L., Bulevardul Oituz, Bl. 13, Sc. A, parter, Ap. 11, Onești, Bacău, Romania (“we”, “us”), the developer of Confy. They apply to the Confy apps for iPhone and Android, the Confy relay service and confychat.com (together, “Confy”). By using Confy you accept these terms. If you don't accept them, don't use Confy.

Our Privacy Policy explains how we handle personal data.

2. Who can use Confy

You must be at least 16 years old. You may not use Confy if you are barred from doing so under the laws that apply to you, or if we have banned you.

3. The service

Confy is a messenger for people who choose to connect with each other, including people who meet at events. Chat has no account signup. Contacts are added by QR code, shared link or pasted contact code, and only after the other person accepts. Messages between contacts are end-to-end encrypted. Private groups require an invitation and your choice to join. Joining shares your Confy code with other members and connects you with them; the owner manages membership. On iPhone, contacts can also chat directly when nearby with the app open on both phones, and can join an optional shared Nearby Room.

Confy is provided free of charge. We may change, suspend or end features, or the whole service, for example for security, legal or technical reasons. Because messages are stored only on your phone, we can't restore lost messages, contacts or keys.

Current access is through the invite-protected private test: iPhone access uses TestFlight and depends on Apple's review and invitation process; Android access uses a test APK. Test builds can expire or change. An invitation code does not guarantee immediate iPhone availability. The current Android test needs the app open to receive messages and does not include iPhone nearby features.

4. Acceptable use

You are responsible for what you send. You must not use Confy to:

• harass, bully, threaten, intimidate or stalk anyone;
• send hate speech, or content that promotes violence or discrimination against people based on who they are;
• send sexual content involving minors, or any content that sexualises or endangers minors;
• send sexual or violent content to people who haven't asked for it;
• impersonate another person or organisation;
• send spam, scams, phishing or malware, or contact people in bulk;
• share someone else's private information or intimate images without their consent;
• promote or arrange illegal activity, or infringe anyone's intellectual property or other rights;
• do anything else that is illegal where you are or in Romania.

You also must not interfere with Confy itself: don't overload, probe or attack the relay or other users' devices, get around rate limits, bans or blocks, or access data that isn't yours. Responsible reports of security problems are welcome at hello@qriton.com.

5. Nearby room rules

The Nearby Room is a shared local chat with people physically near you who have joined. It is off by default, and you must accept the room rules before joining. It is not restricted to the guests of a particular event. In the room:

• everything you write can be read by everyone in the room near you, together with your nickname, and can be screenshotted or reported;
• be respectful: the rules in Acceptable use apply in full;
• don't post personal information about yourself or others, such as phone numbers, addresses or where someone is right now;
• don't flood the room; the app limits how often and how much you can post;
• don't use a nickname that is offensive or that pretends to be someone else;
• meeting people you only know from the room is at your own risk. Meet in public places and tell someone you trust.

The app filters offensive words in messages you send and receive in the room. The filter runs automatically on your phone and can't catch everything, which is why reporting matters.

6. Reporting, blocking and removal

• Block. You can block anyone in the room or any contact. You won't see their messages any more, and a blocked contact can no longer message you or trigger notifications on your phone.
• Report. You can report a person in the room or a contact from the app. A report sends us the reason you give and, for the room, the reported messages, encrypted so that only we can read them. Reporting also blocks that person for you.
• Review and restrictions. Reports are used to assess conduct against these rules. We may restrict a room key through a signed ban list; the iPhone app checks for updates on joining and periodically while open. Restrictions depend on receiving the updated list and do not erase copies already held by others. During private testing, also email us about urgent or unresolved reports. We do not provide a continuously staffed emergency service.
• Illegal content. Where the law requires it, we report content to the competent authorities, for example content related to child sexual abuse or a threat to life.
• Why we act. We act on the content of reports, assessed against these terms and the law. Because Confy has no accounts, we usually can't contact the person concerned, but anyone who believes we made a mistake can write to hello@qriton.com and we will review the decision.
• What we can't see. Messages between contacts are end-to-end encrypted, so we can only act on what users report to us.

7. Licence

We give you a personal, non-exclusive, non-transferable licence to install and use the Confy app on devices you own or control, for personal or professional conversations, in line with these terms and the rules of the store or test service you got it from. You may not sell, rent or sublicense the app, or copy, modify, reverse engineer or create derivative works from it, except where an applicable open-source licence or the law allows this. We and our licensors keep the rights in Confy, including its name and logo. You keep the rights in what you write.

Confy uses open-source components, which are licensed under their own terms.

8. Additional terms for the App Store

If you got Confy from Apple's App Store, these terms also apply:

• This agreement is between you and us only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the app and its content.
• The licence above is a non-transferable licence to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may also be used by other accounts associated with you through Family Sharing or volume purchasing.
• We alone are responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our responsibility, to the extent they can't be excluded under these terms.
• We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar laws.
• If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

• You must comply with any third-party terms that apply when you use the app, such as your mobile data or Wi-Fi provider's terms.
• Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.

9. Disclaimers

Confy is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will always be available, that every message will be delivered, or that it will be free of errors. Undelivered relay messages expire after about 7 days. Nearby chat works only while Confy is open on participating iPhones. End-to-end encryption cannot protect a compromised phone or prevent the recipient copying a message, and it does not hide all connection and timing information.

If you are a consumer, you keep all the rights that consumer law gives you and that can't be excluded by contract, including in the country where you live.

10. Limitation of liability

To the extent permitted by applicable law, we are not liable for indirect or consequential loss, lost data or lost profits arising from use of the service. This does not remove any responsibility or remedy that applicable law requires.

Nothing in these terms limits or excludes liability that can't be limited or excluded by law, including liability for death or personal injury caused by negligence, for damage caused intentionally or through gross negligence, or for fraud.

11. Ending use

You can stop using Confy at any time: use Settings → Delete all data and remove the app. We may ban you from the nearby room if you break these terms, if the law requires it, or to protect other users or the service.

12. Governing law

These terms are governed by Romanian law. Disputes go to the competent courts of Romania. If you are a consumer living elsewhere in the European Union, you also keep the protection of the mandatory laws of your country and may bring a claim in the courts where you live.

13. Changes

We may update these terms, for example when we add features or when the law changes. We will publish the new version on this page with a new date, and we will point out significant changes clearly at the top of this page before they take effect. If you don't accept a change, you can stop using Confy.
